These Terms and Conditions (“Agreement”) govern your use of the platform operated by Connect Skilled Contractors Service LTD, a private limited company registered in England and Wales ("we", "us", or "our").
By accessing or using our website, mobile app, or services (collectively, the "Platform"), you agree to comply with and be bound by this Agreement. If you do not agree with these Terms, do not use our Platform.
1. Definitions
- Operatives: Skilled workers registered with Connect Skilled Contractors Service LTD.
- Clients/Contractors: Businesses or individuals who book operatives via the Platform.
- Platform: The Connect Skilled Contractors Service LTD website, app, systems, and services.
- Booking: A request from a Client to hire one or more operatives via our Platform.
2. Eligibility and Registration
- All users must be at least 18 years old.
- Users must provide accurate and complete information when registering.
- We reserve the right to refuse, suspend, or terminate accounts at our sole discretion.
3. Booking and Use of Operatives
- All bookings are facilitated exclusively through our Platform.
- Clients agree they will not hire operatives directly, attempt to bypass our system, or engage operatives outside our Platform at any time during or within 12 months following any booking.
- Any violation of this clause will result in legal action, a fine up to £25,000 per breach, and permanent banning from the Platform.
4. Ownership and Assignment
- All operatives on our Platform are engaged by us. Clients do not own or employ operatives and must not treat them as direct hires.
- Attempting to solicit operatives to leave our Platform or work directly with a Client is a material breach of this Agreement.
5. Payment and Fees
- Clients agree to pay in advance or as agreed via Stripe or another designated payment gateway.
- All fees are displayed before booking confirmation.
- Additional charges may apply for overtime, cancellations, or custom requests.
- Platform fees are non-refundable unless otherwise stated in writing.
6. Tracking and Monitoring
- Our app uses Google API and other tracking technologies to verify the location of operatives and job progress.
- All chats, images, and files shared within the app are monitored for safety, transparency, and contractual compliance.
- Any attempt to share personal contact details to arrange direct bookings outside the Platform will result in account termination, legal action, and a potential civil claim for damages.
7. Prohibited Use
Users agree not to:
- Scrape data, use bots, or mine information from the Platform.
- Reproduce, republish, or commercially exploit any part of the Platform.
- Use the Platform for unlawful, abusive, or exploitative purposes.
- Bypass or attempt to bypass payment systems.
- Share login details or impersonate others.
IP addresses violating these terms will be permanently blocked. Legal action may follow under the Computer Misuse Act 1990 and Data Protection Act 2018.
8. Limitation of Liability
We do not accept liability for:
- Loss of profit, revenue, or business.
- Temporary outages or service errors.
- Acts of operatives that are outside the scope of engagement.
Our liability for any claim related to use of the Platform is limited to the amount paid by the Client for the specific job or booking giving rise to the claim.
9. Indemnity
You agree to indemnify and hold harmless Connect Skilled Contractors Service LTD, its directors, employees, and affiliates from any claims, damages, or legal fees resulting from your breach of this Agreement or unlawful use of the Platform.
10. Force Majeure
We are not liable for failure to perform due to causes beyond our reasonable control, including natural disasters, government actions, strikes, pandemics, or internet outages.
11. Termination and Suspension
We reserve the right to:
- Suspend or terminate any user account at any time.
- Remove any content that violates our rules.
- Pursue legal remedies for any breach of these Terms.
12. Changes to the Terms
We may update these Terms and Conditions at any time. Continued use of the Platform after changes means you accept the new terms. It is your responsibility to review the latest version.
13. Governing Law and Jurisdiction
These Terms are governed by and interpreted under the laws of England and Wales.
All disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. We may pursue small claims or high court proceedings where necessary.
